國土資源部第61號令《節約集約利用土地規定》於2014年5月22日發布,自2014年9月1日(ri)起(qi)實(shi)施(shi),在(zai)房(fang)價(jia)漲(zhang)跌(die)之(zhi)爭(zheng)處(chu)於(yu)膠(jiao)著(zhe)狀(zhuang)態(tai),各(ge)地(di)限(xian)購(gou)政(zheng)策(ce)存(cun)廢(fei)猶(you)抱(bao)琵(pi)琶(pa)的(de)敏(min)感(gan)時(shi)期(qi),這(zhe)一(yi)部(bu)門(men)規(gui)章(zhang)的(de)出(chu)台(tai),釋(shi)放(fang)出(chu)中(zhong)央(yang)對(dui)土(tu)地(di)管(guan)理(li)怎(zen)樣(yang)的(de)信(xin)號(hao),對(dui)當(dang)前(qian)及(ji)未(wei)來(lai)的(de)房(fang)價(jia)走(zou)勢(shi)及(ji)開(kai)發(fa)重(zhong)點(dian)是(shi)否(fou)會(hui)發(fa)生(sheng)深(shen)遠(yuan)的(de)影(ying)響(xiang)?作(zuo)為(wei)對(dui)土(tu)地(di)政(zheng)策(ce)頗(po)為(wei)關(guan)注(zhu)的(de)一(yi)名(ming)專(zhuan)職(zhi)律(lv)師(shi),依(yi)筆(bi)者(zhe)之(zhi)淺(qian)見(jian),《節約集約利用土地規定》(以下稱《規定》)至少釋放出以下七大政策信號:
一、限定特大城市開發邊界,“副中心”具發展潛力《規定》第九條“國土資源部門應當通過規劃、計劃用地標準、市場引導等手段,有效控製特大城市新增建設用地規模”,第十一條“國土資源主管部門應當在土地利用總體規劃中劃定城市開發邊界和禁止建設的邊界,實行建設用地空間管製”。zheliangtiaobuyueertongdibiaoshi,tedachengshixinzengjiansheyongdidegonggeijiangbeiyangekongzhi,buzaijuyouwubianjiewuxiankuozhandecaozuoxing,weijidaochengshijianshebianjiedexinzengjiansheyongdideshenpijianghuibiandekunnan。tedachengshidejiansheyongdixuqiubudebuxianglianggefangmianxunqiuchukou。yishicunliangdidejiyueliyong,kaifashang、用地單位尋找建成區內可被重新規劃建設、集約利用的土地將成為首選,成本增加也意味著一線城市的房價會日漸稀缺昂貴;二是向特大城市周邊“衛星”城市尋求土地資源,日前被炒作的“副中心”之(zhi)說(shuo)可(ke)見(jian)不(bu)是(shi)空(kong)穴(xue)來(lai)風(feng),離(li)北(bei)上(shang)廣(guang)深(shen)較(jiao)近(jin),同(tong)時(shi)具(ju)備(bei)一(yi)定(ding)潛(qian)力(li)基(ji)礎(chu)的(de)中(zhong)型(xing)城(cheng)市(shi)具(ju)有(you)較(jiao)大(da)的(de)發(fa)展(zhan)空(kong)間(jian),承(cheng)載(zai)為(wei)一(yi)線(xian)城(cheng)市(shi)配(pei)套(tao)或(huo)關(guan)聯(lian)的(de)產(chan)業(ye)功(gong)能(neng),開(kai)發(fa)商(shang)進(jin)入(ru)這(zhe)些(xie)城(cheng)市(shi)的(de)手(shou)段(duan)之(zhi)一(yi),就(jiu)是(shi)通(tong)過(guo)並(bing)購(gou)現(xian)有(you)本(ben)地(di)房(fang)地(di)產(chan)企(qi)業(ye)或(huo)者(zhe)項(xiang)目(mu),本(ben)土(tu)地(di)產(chan)將(jiang)會(hui)迎(ying)來(lai)機(ji)遇(yu).
二、中小城市及縣城供地增加,“城鎮化”步驟加快增加中小城市和縣城建設用地供給,是實施新型城鎮化戰略、fenliuzhongxinchengshiyongdiyalidecuoshi,shishigaixiangzhengcedejieguoshi,zhongxiaochengshihexianchenggongdidenanduhechengbenxiangduijianxiao,keyixiyingengduodachengshiwufaxiaohuadetouzi,xiyinbentuwaichunongmindagongzuhuixiangdingju。zaizhongxiaochengshihexianchengdijiabenlaixiangduijiaodi、kaifayongdigonggeixiangduifuyudeqingkuangxia,tudicuoshibixuyuchanyezhuanyidengqitachengzhenhuazhengcepeitaocainengxianxianxiaoguo。congchangqilaikan,duizhongxiaochengshihexianyujingjishilihaoxiaoxi,dancongjinjieduankan,renmenduiyutudigongyingzengjiadelijiekenenghuizhuanhuaweijiangjiayuqi,zheduiyijing"氣若遊絲"的三四線城市的房地產開發企業,會感覺更加難熬.應防範爆發資金鏈斷裂後借貸糾紛以及降價後退房糾紛頻發的法律風險.
三、立體化設立建設用地使用權鼓勵建設項目用地優化設計、分(fen)層(ceng)布(bu)局(ju),充(chong)分(fen)利(li)用(yong)地(di)上(shang)地(di)下(xia)空(kong)間(jian)。建(jian)設(she)用(yong)地(di)使(shi)用(yong)權(quan)在(zai)地(di)上(shang)地(di)下(xia)分(fen)層(ceng)設(she)立(li)的(de),其(qi)取(qu)得(de)方(fang)式(shi)和(he)使(shi)用(yong)年(nian)期(qi)參(can)照(zhao)在(zai)地(di)表(biao)設(she)立(li)的(de)建(jian)設(she)用(yong)地(di)使(shi)用(yong)權(quan)的(de)相(xiang)關(guan)規(gui)定(ding)。該(gai)項(xiang)規(gui)定(ding)與(yu)《物權法》第136條tiao接jie軌gui,此ci前qian各ge地di方fang已yi有you先xian行xing先xian試shi的de探tan索suo並bing出chu台tai了le一yi些xie地di方fang政zheng府fu規gui章zhang,分fen層ceng設she立li建jian設she用yong地di使shi用yong權quan是shi現xian實shi要yao求qiu和he必bi然ran趨qu勢shi,但dan是shi分fen層ceng設she立li使shi用yong權quan的de主zhu體ti問wen題ti、物權登記問題以及物權遭受損害後的救濟途徑,都有待於出台細則進一步明確.
四、大幅減少劃撥方式用地,公共用地成本增加減少劃撥用地範圍是《規定》的重大改變,根據《劃撥用地目錄》,19類用地都可以用劃撥方式供地,《規定》擴大了土地有償使用的範圍,減少非公益性用地劃撥。除保留軍事、保障性住房和涉及國家安全和公共秩序的特殊用地可以以劃撥方式供應外,其他用地實行有償使用,即將19類lei用yong地di目mu錄lu中zhong包bao括kuo國guo家jia機ji關guan用yong地di在zai內nei的de大da部bu分fen用yong地di都dou排pai除chu在zai劃hua撥bo供gong地di的de範fan圍wei之zhi外wai。這zhe意yi味wei著zhe被bei排pai除chu在zai劃hua撥bo用yong地di範fan圍wei之zhi外wai的de公gong共gong用yong地di主zhu體ti的de用yong地di成cheng本ben大da大da增zeng高gao,比bi較jiao突tu出chu的de是shi機ji關guan辦ban公gong用yong地di和he大da型xing公gong共gong基ji礎chu設she施shi建jian設she用yong地di,此ci類lei用yong地di並bing非fei傳chuan統tong的de出chu讓rang用yong地di,而er且qie帶dai有you公gong益yi性xing質zhi,如ru實shi行xing有you償chang使shi用yong會hui導dao致zhi公gong共gong基ji礎chu設she施shi的de使shi用yong成cheng本ben相xiang應ying增zeng加jia,對dui行xing業ye產chan生sheng較jiao大da影ying響xiang,如ru路lu橋qiao管guan線xian工gong程cheng用yong地di成cheng本ben增zeng加jia,可ke能neng促cu使shi相xiang應ying終zhong端duan產chan品pin提ti價jia,或huo許xu會hui導dao致zhi以yiBT和BOTdengmoshijianshededaxingjichusheshigongchengdehuishouqixianxiangyingyanchang。conglingyigejiaodufenxi,kenenghuilijieweizhengfujiangtudicaizhengdeyalicongchengshizhuzhaiyongdiweizhufensandaoqitagonggonglingyu。

六、工業用地享受差別化待遇《規定》用(yong)第(di)二(er)十(shi)四(si)條(tiao)規(gui)定(ding)在(zai)不(bu)改(gai)變(bian)用(yong)途(tu)的(de)前(qian)提(ti)下(xia),對(dui)現(xian)有(you)工(gong)業(ye)用(yong)地(di)增(zeng)加(jia)土(tu)地(di)利(li)用(yong)效(xiao)率(lv)的(de)行(xing)為(wei),不(bu)用(yong)增(zeng)收(shou)土(tu)地(di)價(jia)款(kuan)。該(gai)條(tiao)規(gui)定(ding)對(dui)於(yu)工(gong)業(ye)企(qi)業(ye)具(ju)有(you)重(zhong)大(da)價(jia)值(zhi),現(xian)有(you)存(cun)量(liang)工(gong)業(ye)用(yong)地(di)將(jiang)成(cheng)為(wei)搶(qiang)手(shou)資(zi)源(yuan),迎(ying)來(lai)並(bing)購(gou)熱(re)潮(chao)。第(di)二(er)十(shi)五(wu)條(tiao)對(dui)工(gong)業(ye)用(yong)地(di)實(shi)行(xing)差(cha)別(bie)化(hua)地(di)價(jia)的(de)政(zheng)策(ce),打(da)破(po)原(yuan)土(tu)地(di)估(gu)價(jia)規(gui)程(cheng)單(dan)一(yi)"級差地價"的de模mo式shi,政zheng府fu可ke以yi通tong過guo集ji約yue化hua程cheng度du和he產chan業ye方fang向xiang兩liang項xiang指zhi標biao,來lai確que定ding工gong業ye用yong地di的de差cha別bie化hua地di價jia,土tu地di供gong應ying成cheng為wei產chan業ye政zheng策ce導dao向xiang的de杠gang杆gan之zhi一yi,但dan需xu適shi度du把ba握wo實shi施shi過guo程cheng中zhong政zheng府fu的de"自由裁量權",避免因工業用地供應滋生腐敗。無論從哪個角度看,政府鼓勵工業發展的良苦用心都值得企業家們好好珍惜和利用。
七、城鎮存量土地開發主體創新《規定》第三十二條規定,鼓勵社會資金參與城鎮低效用地、廢(fei)棄(qi)地(di)再(zai)開(kai)發(fa)和(he)利(li)用(yong),鼓(gu)勵(li)土(tu)地(di)使(shi)用(yong)者(zhe)自(zi)行(xing)開(kai)發(fa)或(huo)者(zhe)合(he)作(zuo)開(kai)發(fa)。結(jie)合(he)對(dui)城(cheng)市(shi)新(xin)增(zeng)建(jian)設(she)用(yong)地(di)限(xian)製(zhi)供(gong)應(ying)的(de)前(qian)文(wen),應(ying)理(li)解(jie)為(wei)政(zheng)府(fu)對(dui)符(fu)合(he)城(cheng)市(shi)規(gui)劃(hua)的(de)存(cun)量(liang)土(tu)地(di)"挖潛",係鼓勵多渠道多形式的改造和利用。在《國有土地上征收與補償辦法》出台,同時《城市房屋拆遷補償條例》廢fei止zhi後hou,除chu公gong益yi性xing質zhi的de土tu地di征zheng收shou適shi用yong征zheng補bu條tiao例li之zhi外wai,其qi他ta項xiang目mu的de拆chai遷qian成cheng為wei模mo糊hu空kong間jian。但dan城cheng市shi要yao發fa展zhan,必bi然ran會hui有you商shang業ye性xing質zhi的de改gai造zao和he拆chai遷qian,該gai規gui定ding的de出chu台tai,指zhi出chu土tu地di使shi用yong者zhe可ke"自行開發"和"合作開發"的路徑,或許在不久的將來,"被拆遷人"buzaishichaiqianhu,ershitongguoyukaifashanghezuo,chengweikaifaquanyidexiangyouzheheshouyizhe,nayangdechaiqianshijiyouliyuchengshifazhanhetudijiyueliyong,younengshixianxianyoutudishiyongquanrendeliyihekaifashangdeshangyeliyi,gefanggongyingdejumiankeqi。
